First OMB pre-hearing conference held for ADI development, 374 Martha St.

On July 13, 2015, the Ontario Municipal Board (OMB) heard from lawyers for each of the parties in the appeal by ADI Developments of their proposed 28-storey condo at 374 Martha St. Represented at the pre-hearing were: the City of Burlington, ADI Developments, Martha Terrace (395 Martha St.), the Region of Halton, and the owner of the abutting single detached house. Several residents in attendance also spoke at the pre-hearing.

The OMB has ordered a further pre-hearing conference to be held on December 4, 2015 for the hearing of any motions or procedural matters, and has set a three week hearing date beginning on March 14, 2016.

In report PB-23-15, City planning staff recommended refusal of ADI’s application. At the Mar. 30 Development & Infrastructure Committee meeting councillors unanimously voted to endorse the staff recommendation to refuse the application. City Council upheld that recommendation on Apr. 20. Though council was no longer the decision-maker on the file at the time of our vote, as it had already been appealed to the OMB, council’s position on this matter in support of staff’s refusal of the application will be conveyed to the OMB at the hearing.
